Brazil’s Federal Regional Court of the 3rd Region (TRF3) has overturned a temporary exemption granted to Stake. The Stake Brazil court ruling was issued on 9 October 2026. The decision means the operator is again subject to Brazil’s nationwide online gambling ban.
- Court reverses exemption: On 8 October, a federal court in São Paulo allowed Stake to continue operating until 25 October. The federal government challenged the decision. The TRF3 overturned the exemption the following day.
- Equal treatment of operators: The court argued that allowing Stake to operate while other licensed companies remained blocked would create unequal conditions. The Stake Brazil court ruling therefore removes the operator’s temporary protection. Authorities can resume enforcing restrictions against Stake.
- Gambling ban remains in place: Brazil’s nationwide restrictions took effect on 6 October. Stake had obtained temporary legal protection against enforcement. The latest decision does not settle the broader legal dispute over the ban.
- Legal proceedings continue: The court noted that Brazil’s Supreme Federal Court (STF) is reviewing challenges to the gambling ban. Judge Luis Antonio Johonsom di Salvo said individual exemptions could weaken enforcement of the nationwide restrictions. The Stake Brazil court ruling remains in effect unless changed by a later court decision.
- Stake confirms shutdown and refunds: Stake confirmed that its website and app have been unavailable since 10 October following the court decision. Bets settled by 9 October were paid, while outstanding bets were cancelled and stakes returned to player balances. Remaining funds, including winnings and eligible bonuses, will be refunded automatically to players’ bank accounts within seven days after payment providers receive the relevant details.
